Terms and Conditions for Dreamland

1. Agreement to Terms

By accessing or using the Dreamland mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("you" or "User") and Dreamland ("we," "us," or "our").

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms in the App
  • Updating the "Last Updated" date
  • Sending you a notification (for significant changes)

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

3. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the App.

By using the App, you represent and warrant that you meet these eligibility requirements.

4. Description of Service

Dreamland is a dream interpretation and journaling application that provides:

  • AI-powered dream analysis and interpretation
  • Dream history tracking and organization
  • Personalized insights based on your personality and mental health context
  • Additional features as described in the App

Not Medical or Mental Health Advice:

  • Dreamland is for entertainment and self-reflection purposes only
  • Our AI-generated interpretations are NOT professional medical, psychological, or mental health advice
  • Do not use the App as a substitute for professional mental health care
  • If you are experiencing mental health issues, please consult a qualified mental health professional

AI Limitations:

  • Dream interpretations are generated by artificial intelligence and may not be accurate
  • Interpretations are subjective and based on general psychological and cultural symbolism
  • AI may misinterpret context or provide inconsistent results
  • We do not guarantee the quality, accuracy, or usefulness of any interpretation

5. User Accounts

Account Creation

To use the App, you must create an account by providing:

  • A valid email address
  • Other information as requested during onboarding

You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account

Account Responsibility

You are responsible for all activity that occurs under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of the service or other users
  • Non-payment of subscription fees

You may delete your account at any time through the App's Settings. Account deletion is permanent and cannot be undone.

6. Subscriptions and Payments

Subscription Service

Dreamland offers access to premium features through auto-renewing subscriptions:

  • Weekly subscriptions
  • Monthly subscriptions
  • Annual subscriptions

Subscription details, including pricing, are displayed in the App and may vary by region.

Free Trial

We may offer a free trial period for new subscribers. You will be charged the subscription fee when the trial period ends unless you cancel before the trial expires.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date.

Payment

All payments are processed through Apple's In-App Purchase system. Your iTunes Account will be charged upon confirmation of purchase.

Apple's payment terms and policies apply to all transactions. We do not have access to your payment information.

Cancellation

You can cancel your subscription at any time through your Apple ID settings:

  1. Open Settings on your iOS device
  2. Tap your name, then Subscriptions
  3. Select Dreamland and tap Cancel Subscription

Cancellation takes effect at the end of your current billing period. You will not receive a refund for the remaining days of your current subscription period.

Refunds

All sales are final. Refund requests must be made through Apple. We do not control Apple's refund policy or process.

Price Changes

We may change subscription prices at any time. Price changes will be communicated in advance and will apply to the next billing period after the change.

7. User Content

Your Dream Content

You retain all ownership rights to the content you submit to the App, including dream descriptions and other personal information ("User Content").

By submitting User Content, you grant us a limited license to:

  • Store your content on our servers
  • Process your content to generate AI interpretations
  • Display your content back to you in the App
  • Use aggregated, anonymized data for service improvement and analytics

This license terminates when you delete your content or account, except for:

  • Anonymized, aggregated data (which cannot be linked back to you)
  • Content retained for legal or security purposes as described in our Privacy Policy

Your Responsibilities

You are solely responsible for your User Content. You agree not to submit content that:

  • Violates any law or regulation
  • Infringes on intellectual property rights
  • Contains viruses, malware, or malicious code
  • Harasses, threatens, or harms others
  • Contains explicit sexual content involving minors
  • Promotes violence, hatred, or discrimination

We reserve the right to remove any User Content that violates these Terms, without notice.

No Monitoring Obligation

We are not obligated to monitor User Content but reserve the right to do so for:

  • Legal compliance
  • Safety and security purposes
  • Terms enforcement

8. Prohibited Uses

You agree NOT to:

Technical Violations:

  • Reverse engineer, decompile, or disassemble the App
  • Attempt to gain unauthorized access to our systems
  • Use automated tools (bots, scrapers, etc.) to access the App
  • Interfere with or disrupt the App's functionality
  • Bypass any security measures

Content Violations:

  • Upload harmful, offensive, or illegal content
  • Impersonate others or provide false information
  • Spam or solicit other users
  • Share your account credentials with others

Commercial Violations:

  • Use the App for commercial purposes without our permission
  • Resell or redistribute our services
  • Frame or mirror any part of the App

9. Intellectual Property

Our Content

The App and all its contents, features, and functionality (including but not limited to text, graphics, logos, icons, images, audio clips, and software) are owned by Dreamland or its licensors and are protected by copyright, trademark, and other intellectual property laws.

AI-Generated Content

Dream interpretations generated by our AI are considered our intellectual property, created based on your input. You may use these interpretations for personal, non-commercial purposes only.

Trademarks

"Dreamland" and our logo are trademarks of Dreamland. You may not use these without our prior written permission.

10. Third-Party Services

The App integrates with third-party services:

  • AI interpretation services (OpenRouter)
  • Backend infrastructure (Convex)
  • Subscription management (RevenueCat)
  • Apple's In-App Purchase system

These services are governed by their own terms and privacy policies. We are not responsible for the practices or content of third-party services.

User Obligations: You must comply with all applicable third-party terms of service when using the App, including but not limited to your wireless data service provider's terms and conditions. You are solely responsible for any charges incurred from third-party services (such as data charges from your mobile carrier) while using the App.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security or freedom from viruses or harmful components

Medical Disclaimer: We expressly disclaim any warranty that the App is suitable for medical, mental health, or therapeutic purposes. Dream interpretations are for entertainment only and should not be relied upon for health decisions.

AI Disclaimer: We do not warrant that AI-generated interpretations will be accurate, helpful, or appropriate. AI may produce errors, biases, or inappropriate content.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Indirect Damages:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Business interruption
  • Personal injury or emotional distress resulting from use of the App

Direct Damages: Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Exclusions: Some jurisdictions do not allow the exclusion of certain warranties or liability for certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Dreamland, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your User Content
  • Your violation of any third-party rights

14. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

15. Export Control

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

16. Apple-Specific Terms

Because the App is distributed through the Apple App Store, the following terms apply:

Acknowledgment

You acknowledge that:

  • These Terms are between you and Dreamland, not Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide support for the App

Scope of License

The license to use the App is limited to a non-transferable license to use the App on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple App Store Terms of Service.

Maintenance and Support

We, not Apple, are solely responsible for providing maintenance and support services for the App as specified in these Terms or as required by applicable law.

Warranty

You acknowledge that, in the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

Product Claims

We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including:

  • Product liability claims
  • Claims that the App fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection laws

Intellectual Property

If a third party claims that the App infringes their intellectual property rights, we, not Apple, will be responsible for the investigation, defense, settlement, and discharge of any such claim.

Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dreamland regarding the use of the App and supersede all prior agreements and understandings.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of these Terms must be in writing and signed by us.

20. Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

BY USING DREAMLAND, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE APP.
